19. Notwithstanding the provisions of the following Regulations regarding the making of appointments, all persons whose appoint- ments are otherwise provided for by law must be dealt with in accordance with such law.
Procedure regarding appointments (including promotions) requiring the approval of the Governor.
20. Appointments (including promotions) in the Public Service to posts in which the initial pensionable or non-pensionable salary of the officer to be appointed will exceed £600 or Rs. 9,000 per annum require the approval of the Governor.
21. Whenever it is necessary to make an appointment requiring the approval of the Governor to a post under the Government of Ceylon the procedure hereinafter prescribed shall be observed except in the case of appointments of the Governor, his personal staff and the staff of his office and appointments for which special procedure has been prescribed by the Ceylon (Constitution) Order in Council 1946 or any written law.
22. (i.) As soon as it is known that a vacancy will occur in the post of a Head of Department the latter should, before he relinquishes his duties, report the matter to the Permanent Secretary to the Minis- try. If for any reason the Head of the Department is unable to report the impending vacancy, the officer acting for such Head or the next senior officer in the Department shall make the required report. The report should be made in duplicate.
(ii) Upon receipt of the report referred to in paragraph (i.), the Permanent Secretary will address the Secretary to the Public Service Commission and make his recommendation as to how the vacancy should be filled. The Public Service Commission, through its Chair- man, will then advise the Governor regarding the filling of the
vacancy.
23. The Permanent Secretary to the Ministry of Justice will make recommendations to the Public Service Commission for filling non- judicial posts on the staff of the Supreme Court, the initial salaries of which exceed £600 or Rs. 9,000 per annum. The Public Service Com- mission, through its Chairman, will advise the Governor regarding the filling of the vacancies.
24. (i.) As soon as it is known that a vacancy will occur in any post other than that of Head of a Department, the Head of the Department concerned or the officer acting for him should report the impending vacancy to the Permanent Secretary to the Ministry. The report should be made in duplicate.
(ii.) The Head of the Department or the officer acting for him should, at the time of making the report required by paragraph (i.), make his recommendation as to how the vacancy should be filled.
In any case, however, where it is known that a vacancy will occur in any post other than that of Head of a Department by reason of the fact that the officer holding that post is to be appointed to the post of Head of the Department, the recommendation made by the Head of the Department as to the filling of the vacancy should be accompanied by the recommendation of the prospective Head of the Department.
(iii.) Upon receipt of the report and recommendations referred to above the Permanent Secretary will address the Secretary to the
